Magistrate Clerk

Forms to file a dispossessory warrant in Georgia are pretty much the same through out the state. However, the 'How To File' is controlled by the procedures and rules of each county's clerk.

Our process will save you time and ensure your case is handled accurately.

The forms seem simple, but a tiny mistake can cost you weeks of wasted time or even determine if you win or lose your case before you even start.

The clerks will allow you to file the forms however you like. They are not allowed to give you advice.

How Long Will It Take?

WHEN WE LIVED ON PLANET EARTH
Your case would be in court in 3 to 5 weeks after you file.
The Writ of Possession is normally available to file for one week after your hearing date.
The entire process, filing to your day in court to the eviction of your tenant, could take 8 to 12 weeks.

Temporary State rules are changing on a monthly basis.
County rules are changing on a weekly basis.
Courthouses shut down with the state mandate and local Covid outbreaks.
This process will take a very long time.

Step 3: Court

We Have a Court Date - Now What?

We have filed your case, and they have answered. Let the process take over. Your lease doesn't really matter anymore. The only document that matters is the judgment that will happen in court.

Our Attorney Can Represent You In Court

You will only have to attend the case if the attorney determines your testimony is needed. Examples of reasons why your testimony would be needed are but not limited to: no written lease, tenant claims repairs were not done, or tenant files a counterclaim against you.

The fee for step 3 covers one attorney appearance in magistrate court for your case.
